Michael Scheinberg, as part of an equity panel, discussed how terms for equity markets (including returns, governance, provisions relating to guaranties and preferred property types) have changed over the past few years in light of the economic downturn. As reported in Bisnow, Mr. Scheinberg spoke about greater focus in JV agreements on guaranties, in particular for development deals, and related indemnification and replacement provisions in light of recent court decisions relating to "recourse."
